These Terms of Use (“Terms”) govern your access to and use of the Understanding Bone Health website and its content (the “Site”), operated by Josi Clary Coaching (“we,” “us”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Who we are
The Site is operated by Josi Clary Coaching, the health-coaching practice of Josi Clary, in California, United States. Our mailing address is available on request, and you can reach us through the contact form.
Educational use — not medical advice
The Site is for general education only and is not medical advice. Your use is subject to our Medical Disclaimer, which is incorporated into these Terms by reference. The interactive tools are simplified illustrations and estimates, not diagnostic instruments.
Josi’s role and qualifications
Josi Clary is an Integrative Nutrition Health Coach (Institute for Integrative Nutrition, 2021). She is not a licensed physician, psychologist, dietitian, nurse, pharmacist or other provider of medical or psychological services, and she is not licensed by the State of California as a healing arts practitioner. Her services are educational and supportive. They are offered alongside, and never in place of, care from the licensed clinicians you choose. She does not diagnose, treat, prescribe, interpret test results, or recommend starting, stopping or changing any medication.
Your health and exercise decisions
You are responsible for your own health decisions and for checking them with your own clinicians. Exercise, impact and loading activities, dietary changes and supplements discussed on the Site carry risks, especially if you have osteoporosis, a prior fracture or another medical condition. If you choose to act on anything you read on the Site or discuss in coaching, you do so at your own risk and, we strongly recommend, only after getting clearance from your physician or another qualified professional. This does not reduce any responsibility we have under the law for our own negligence or misconduct.
Medical Advocacy program
Josi Clary Coaching offers a paid, one-to-one Medical Advocacy program (the “Program”). The Program is coaching and advocacy support: help organizing your health history and medication list, preparing questions for your clinicians, understanding how referrals and public programs generally work, and preparing materials you will submit yourself. It is not medical care, legal services, insurance brokerage, or care management, and our Medical Disclaimer applies to it in full. Sessions are offered at the rate published on the Medical Advocacy page (currently $125 per hour) and are billed for the time used, including any work between sessions that you have agreed to in advance. Scheduling, rescheduling, cancellation, and payment details are confirmed with you in writing before your first paid session and form part of these Terms. Fees are private pay; Josi Clary Coaching does not bill insurers, and the Program is generally not covered by insurance. Services are personal to you and may not be resold. Any contact with a third party about you occurs only under a separate written permission you sign. You remain responsible for all decisions about your health, for following your clinicians’ advice, for any application, appeal, or filing you choose to submit, and for how you store and share any documents prepared in coaching. No outcome of any kind, including any referral, test, approval, coverage decision, program enrollment, or health result, is promised or guaranteed. Either you or Josi Clary Coaching may end the engagement at any time; you are responsible only for time already provided or approved. The Program is offered to adults 18 and over; a client may be accompanied by a helper of their choosing.
Before your first paid session we will confirm in writing the scope of the work, fees, and cancellation and refund terms. If a written agreement you sign differs from these Terms, the signed agreement controls.
The Advocacy Guide (pay what you want)
The Testing & Advocacy Center’s toolkit, “The Advocacy Guide,” is offered on a pay-what-you-want basis. Access is granted on request: you enter your email address on the Advocacy page and receive an access code, whether or not you send a gift. The code unlocks the online toolkit on the devices you use, and every section can be printed or saved as a PDF from your browser. The suggested $25 is a voluntary gift to Josi Clary Coaching sent through Venmo. It is not a purchase, it buys nothing that the free request does not already give you, and it is not refundable. Venmo’s own terms and privacy policy apply to any gift; no payment is processed on this Site, and we never see your card or bank details. Access codes are for your own personal, non-commercial use. Please do not share, publish, resell, or post your access code or the guide’s contents; we may change the access system or issue new codes if sharing becomes widespread. Access is for the current edition; we may update, add to, or reorganize the content over time, and we may retire features with reasonable notice. The Advocacy Guide is educational material, not medical advice; the Medical Disclaimer applies to it in full. It does not include coaching time; sessions are a separate service described above.
Intellectual property
Unless otherwise noted, the Site’s text, design, graphics, interactive tools, the Advocacy Guide, and the free downloadable guide are the property of Josi Clary Coaching and are protected by intellectual-property laws. You may view the Site, download the free guide, and use the Advocacy Guide for your own personal, non-commercial use. You may not reproduce, republish, sell, or distribute the Content for commercial purposes without our prior written permission.
Third-party names, marks, and endorsements
References on the Site to third parties — including Dr. Vonda Wright, the Buck Institute and its Move the Mountain™ initiative, and Echolight (maker of REMS bone-scan devices) — are for educational and informational purposes. All third-party names and marks belong to their respective owners. Such references do not imply endorsement, sponsorship, or affiliation unless we state so expressly in writing. Josi Clary Coaching is independent of, and not affiliated with, these parties.
Donations and gifts
The Site provides a link to donate to the Buck Institute, a separate nonprofit organization. Any such donation is a transaction directly between you and the Buck Institute, made on the Buck Institute’s own website and subject to its terms and privacy policy. Josi Clary Coaching does not process, collect, hold, or retain any portion of that donation, and is not responsible for the donation transaction or any tax treatment of your gift. The optional gift for the Advocacy Guide, described above, is a separate voluntary gift to Josi Clary Coaching made on Venmo. It is not a purchase, it is not a charitable contribution, it is not refundable, and it is not tax-deductible.
Third-party services and external links
The Site relies on, and links to, services and websites run by others, including Venmo (for optional gifts), the Buck Institute’s donation page, our form-delivery and email providers, our hosting and analytics provider, and Google Translate (only if you choose a language). Your use of those services is governed by their own terms and privacy policies, and we do not control them. To the extent permitted by law, we are not responsible for their content, accuracy, availability, security or practices, and providing a link is not an endorsement.
Automated translation
Non-English versions of the Site are produced by an automated third-party translation service and may be inaccurate. The English version controls. We are not responsible for translation errors.
Use of AI tools
AI tools help with research, drafting, editing and building this Site. A person reviews every substantive health claim against its cited sources before publication. Independent review by a licensed clinician is being set up and is not yet complete; each article, the main guide and the Testing & Advocacy Center carry a review line saying whether it has been independently reviewed. See our Editorial standards.
No warranties
The Site, its content, the interactive tools, the free guide and the Advocacy Guide are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
We do not promise that the Site will be uninterrupted, secure or error-free, or that any content is complete or current. We provide the Medical Advocacy program with reasonable care and skill, but we do not promise any particular result. Some places do not allow certain warranty disclaimers, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law: (a) Josi Clary Coaching and Josi Clary will not be liable for any indirect, incidental, special or consequential damages, or for lost profits, lost data or the cost of substitute services, arising out of or related to the Site, its content, the Advocacy Guide or the Medical Advocacy Program, even if we were told such damages were possible; (b) our total liability for all claims related to the Site, its content or the Advocacy Guide will not exceed one hundred U.S. dollars ($100); and (c) our total liability for all claims related to the Medical Advocacy Program will not exceed the fees you paid us for the Program in the twelve months before the event that gave rise to the claim.
What this does not limit. Nothing in these Terms excludes or limits liability that the law does not allow to be excluded or limited. That includes liability for fraud, for willful injury to a person or property, for gross negligence, for violation of law, and for death or personal injury where the law does not permit a limit. Nothing in these Terms waives any right you have under the California Consumers Legal Remedies Act or any other consumer-protection law that cannot be waived. Where a limit in this section is not allowed, it applies only as far as the law allows.
Most of the Site is free, and the Program is educational coaching rather than professional care. These limits reflect that and are part of the basis on which we offer them.
Indemnification
To the extent permitted by law, you agree to reimburse Josi Clary Coaching for reasonable losses and costs arising from third-party claims caused by your breach of these Terms, for example by publishing or reselling the Advocacy Guide. This does not apply to any claim to the extent it arises from our own negligence or misconduct.
Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California.
Severability and entire agreement
If a court finds any part of these Terms unenforceable, that part will be enforced as far as the law allows and the rest of the Terms will remain in effect. These Terms and the Medical Disclaimer, together with any signed engagement agreement, are the whole agreement between us about their subject. Our Privacy Policy explains how we handle information; it is a notice, not part of this agreement.
Changes
We may update these Terms. Changes take effect when posted, as shown by the “Last updated” date above. They apply to use of the Site from that date, do not apply to disputes that arose before it, and do not change a signed engagement agreement unless you agree in writing.
